Disclaimer and Waiver of Liability: Schott's Mobile Mechanics
Effective Date: June 19, 2025
By engaging Schott's Mobile Mechanics for services, you ("the Customer") acknowledge and agree to the following terms and conditions. Please read this disclaimer carefully before authorizing any work on your vehicle.
1. General Services Disclaimer
Schott's Mobile Mechanics strives to provide high-quality and professional mobile automotive repair and maintenance services. Our goal is to diagnose and repair issues efficiently and effectively. However, due to the inherent complexities of vehicle mechanics and the nature of mobile repairs, we cannot guarantee specific outcomes or foresee every potential issue that may arise during or after service.
2. Disclaimer Regarding Aged or Deteriorated Parts (Including Plastic Hoses and Components)
When working on vehicles, especially older models, certain components may be significantly aged, brittle, or deteriorated due to heat, chemicals, wear, and environmental exposure. This is particularly true for plastic hoses, lines, connectors, reservoirs, and other plastic or rubber parts within the engine bay and undercarriage.
Please be advised of the following risks associated with aged components:
* Increased Fragility: Old plastic and rubber components can become extremely fragile and brittle. Even with the utmost care, the act of touching, disconnecting, or manipulating these parts during routine diagnosis or repair (e.g., removing a sensor, disconnecting a hose to access another component) can cause them to crack, break, leak, or otherwise fail.
* Unforeseen Damage: Damage to such components may occur unexpectedly during service, even if they appeared to be in working condition prior to the repair. This is a risk inherent to working with aged materials and is not necessarily indicative of negligence or improper technique by Schott's Mobile Mechanics.
* Additional Repairs and Costs: Should an aged part break or fail during the course of a repair, it will necessitate additional diagnosis, parts, and labor to rectify. Such additional repairs and their associated costs will be the responsibility of the Customer. Schott's Mobile Mechanics will inform the Customer immediately if such an event occurs and provide an estimate for the necessary additional work before proceeding.
* Limitations on Warranty: Our warranty, if any, will generally not cover failures of pre-existing aged or deteriorated parts that break during the service process, unless the damage is directly attributable to gross negligence on our part.
3. Customer Responsibility
You, the Customer, are responsible for informing Schott's Mobile Mechanics of any known pre-existing conditions, modifications, or concerns regarding your vehicle, especially those related to aged components.
4. Limitation of Liability
To the fullest extent permitted by law, Schott's Mobile Mechanics, its employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damage to property, loss of profits, or personal injury, arising out of or in connection with:
* Services performed on your vehicle.
* The failure of aged or deteriorated components, including plastic hoses and parts, during or after service, unless such failure is due to our gross negligence or willful misconduct.
* Any unforeseen issues or additional repairs necessitated by the condition of your vehicle.
5. By authorizing Schott's Mobile Mechanics to perform work on your vehicle, you acknowledge that you have read, understood, and agree to the terms of this Disclaimer and Waiver of Liability, including the specific risks associated with aged or deteriorated parts. You agree to hold Schott's Mobile Mechanics harmless for any damage to, or failure of, such components that may occur during the course of service, except in cases of gross negligence.
